1. Acceptance of Terms
By accessing or using the WheelIt Transportation mobile app (“App”) and services (“Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Services.
2. Eligibility
You must be at least 13 years old to use the Services. By using the App, you represent and warrant that you meet this requirement and are legally capable of entering into binding contracts.
3. Account Registration
To access certain features, users may be required to create an account. You agree to provide accurate and complete information and to keep your credentials confidential. You are responsible for all activity under your account.
4. Ride Booking Terms
Users may schedule rides with verified drivers through the App. Ride details such as pickup and drop-off locations, time, and cost are displayed before booking. Users must ensure their availability at the scheduled time.
5. Driver-User Relationship
WheelIt Transportation connects users with independent drivers. We do not employ drivers and are not responsible for their conduct. All rides are provided by third-party drivers.
6. Payments
All payments are processed securely through Stripe. By using our App, you agree to Stripe’s terms and authorize us to charge your selected payment method for all booked rides.
7. Cancellation and Refund Policy
Users may cancel scheduled rides under the cancellation terms displayed within the App. Refund eligibility depends on timing and circumstances. We reserve the right to deny refunds in case of misuse.
8. Prohibited Activities
Users agree not to:
– Violate any laws or regulations
– Interfere with or disrupt the Services
– Misuse or reverse-engineer the App
– Harass or harm other users or drivers
9. Intellectual Property
All content, branding, logos, and technology used in the App are owned by WheelIt Transportation and protected by applicable intellectual property laws. You may not use, copy, or distribute our assets without permission.
10. Disclaimers and Limitation of Liability
The Services are provided “as is” without warranties of any kind. We are not liable for indirect or incidental damages arising from your use of the App, including those caused by drivers or third parties.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved within courts located in Ontario, Canada.
12. Dispute Resolution
In the event of a dispute, you agree to first contact us for resolution. If not resolved, the matter may proceed to arbitration or small claims court in Ontario, Canada.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms, misuse our Services, or engage in harmful conduct.
14. Modifications to Terms
We may update these Terms from time to time. Continued use of the App after changes signifies your acceptance. The “Effective Date” above reflects the latest revision.
